Back in March we told you about a couple of seventysomethings, Howard and Gloria Schwartz, who sued their upstairs neighbor, entertainment mogul David Geffen, for causing $2 million in damages to their Fifth Avenue co-op apartment during renovations to his $54 million penthouse duplex.

Now the beleaguered mogul’s lawyer, Walter White, has filed papers in Manhattan Supreme Court asking a judge to strike certain “prejudicial and scandalous” language from the lawsuit, including the words “gut renovation” and the septuagenarian plaintiffs’ description of themselves as “senior citizens.” Perhaps “junior citizens” would be less prejudicial and scandalous?

“I read the motion and I’m still scratching my head wondering what Mr. Geffen’s lawyer is thinking,” the Schwartz’s attorney, Steven Sladkus, told the New York Post. “I’m stunned by the silliness of the motion. All it serves to do is increase costs, which are recoverable ultimately from Mr. Geffen.”​
